Terms of Use for Mortgage Broker

Welcome to our mortgage broker platform. These Terms of Use (“ToU”) contain important information regarding the services that we provide to you for your own protection. By accepting the ToU, you agree to comply with its provisions when you access and use our services. Please read them carefully before accepting them and using our platform..

1. Services and Scope of Use

1.1. Our platform provides mortgage brokerage services, allowing users to submit mortgage loan applications and receive assistance in finding suitable mortgage products.

1.2. Users must be of legal age to use our services. By accessing our platform, you represent, warrant and confirm that you are of legal age.

1.3. The services provided on our platform are intended solely for personal and non-commercial use. Any unauthorized commercial use or resale of our services is strictly prohibited.

2. User Account

2.1. To use certain features of our platform, you may need to create a user account. You are responsible for maintaining the confidentiality of your account credentials and ensuring their security.

2.2. You agree to provide accurate and up-to-date information when creating your user account and submitting mortgage applications. It is your responsibility to ensure that information or documentation provided by you is accurate, correct, complete, up to date and not misleading in any respect.

2.3. If you suspect any unauthorized access to your account or other security breaches, you must notify us immediately.

3. Mortgage Applications

3.1. When submitting a mortgage loan application through our platform, you agree to provide truthful and accurate information about your financial situation and creditworthiness.We reserve the right to request additional information or documentation in order to ascertain your financial situation and creditworthiness. You understand and accept that under such circumstances there may be a delay with processing the application, or a risk of the application being rejected should insufficient information be provided.

3.2. You will indemnify us and hold us harmless from any liability arising out of any failure by you to provide us with any information or documents that we request, as well as for any error, omission, inadequacy or inaccuracy in any information and/or documents that you provide to us.

3.3. You acknowledge that we will rely on and use the information provided in your mortgage application to assist you in finding suitable mortgage products. However, we do not guarantee approval or the availability of specific mortgage offers.

3.4. Our platform acts as an intermediary and facilitates the submission of mortgage applications to authorized banks and financial institutions. We do not make lending decisions, and final approval is at the discretion of the respective lenders.

3.5 You acknowledge that it is your sole responsibility to repay the mortgage and pay interest (if required by the bank). The obligation to pay back a mortgage remains even if the value of the underlying asset for which the mortgage was taken out declines.

3.6 You will be responsible for all filings and reports on any mortgages obtained through the platform and for the payment of all taxes, interest or other liability arising out of, or in connection with such mortgage.

4. Intellectual Property

4.1. All content and materials on our platform, including software, scripts, sounds, logos, trademarks, text, graphics, and images, are the property of our company or its licensors and are protected by intellectual property laws.

4.2. You may not reproduce, modify, distribute, or use any content from our platform without our prior written consent.

4.3 The platform content may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed or otherwise exploited for any purpose without our prior written consent.

4.4 You undertake (a) not to circumvent, disable or otherwise interfere with the security features of the platform or in the restrictions/limitations relating to the use of the content; (b) not to carry out any data recovery on the platform (c) not to interfere with the platform or damage it by the introduction of malicious or harmful material.

5. Limitation of Liability

5.1. We strive to provide accurate and reliable information through our platform. However, we do not warrant or guarantee the completeness, accuracy, or timeliness of the information.

5.2. We are not responsible for any loss, damage, or inconvenience arising from the use of our platform or reliance on the information provided.other than as a result of our own fault or negligence.

5.3. We do not guarantee the results of any of your investments nor guarantee that you will generate profits or income from your objective. We are not liable for any losses suffered by you (which shall include loss of profits, income or capital, costs, expenses, claims or damages) including losses arising from:

a) Negligence, willful default, fraud or insolvency of any other person;

b) Us carrying out or relying on instructions or on any information provided or made available by you;

c) Market conditions or changes in market conditions; or

d) Any delayed receipt, non-receipt, loss or corruption of any information contained in email or for any breach of confidentiality resulting from email communication or any consequential loss arising from either of the foregoing.

5.4 In particular, but without limitation, we shall not be liable for any default of any counterparty, bank, or any other entity which holds money, investments or other documents of title on your behalf or with or through whom transactions are conducted for you.

5.5. Our liability is limited to the extent permitted by applicable law.

6. Modifications to Terms of Use

6.1. We reserve the right to update or modify these Terms of Use at any time. Changes will be effective immediately upon posting on our platform and will be notified to you at the email address you used to create your account. Your continued use of our services after the changes are notified to you, constitutes your acceptance of the revised ToU.

7. Data Protection and confidentiality

7.1 We may collect, use and store personal information which you provide from time to time including Personal Data and Sensitive Personal Data within the meaning given to the terms in Federal Decree Law No. 45/2021 on the Protection of Personal Data (the “PDPL”). Please refer to the Privacy Policy [ME1] to know more about how we collect and process your data and what your rights are according to the PDPL.

7.2 You consent to us using and holding your Personal Data in accordance with our Privacy Policy

7.3 Each party agrees and confirms that any information received from the other party orally or in writing for the purpose of the mortgage application is confidential information. Each party shall keep such information confidential and cannot disclose any related information without the other party’s prior consent, but the following information shall not subject to such confidentiality:

8. Governing Law and Disputes

8.1. These ToU are governed by the laws of the United Arab Emirates (“UAE”). .

8.2. Any disputes arising from the use of our platform or services shall be subject to the exclusive jurisdiction of the courts of Dubai in the UAE.
